Depending on circumstances, you may still have grounds to file a lawsuit.

If the accident was not 100% your fault, it’s still possible to recover damages from the other party for the portion of the accident that was not your fault.  This is especially true if the reason for the citation (speeding, for example) was not an immediate or substantial cause of the accident.

In New York State, injured parties can bring claims against others, even if the plaintiff was partially at fault in the accident.
