A woman who miscarried her 14-week old fetus and then suffered a severe personal injury in the ensuing dilation and curettage procedure back in 2007 was awarded $2.5 million by a jury in Ann Arbor, Michigan. Amy Garcia, who is from Novi, Michigan, sued St. Joseph Mercy Hospital in Ann Arbor, where the procedure occurred. Even though the procedure is common – her physician promised Garcia that she would be “home by lunch” – a resident physician perforated her uterus, directly resulting in her personal injury.
Garcia’s medical malpractice lawsuit asserted that Dr. Norman Gove, her physician, failed to properly supervise the procedure. Moreover, he failed to communicate to her that a resident physician would be performing the procedure. The resident physician accidentally inserted ring forceps through the perforated uterus and grabbed a piece of bowel that snapped back, tearing her bowels and rectum, the lawsuit states. Consequently, Garcia had to undergo a ileostomy to create an opening in the skin to pass intestinal waste in order to collect it in a bag. Garcia wore the ileostomy bag for 3 months after the procedure.
