In less than a second, a serious truck accident can change your life forever. Due to their size and weight, 18 wheelers can pack a punch, causing severe injuries and property damage.
If you suffered injuries in a truck crash, you may be entitled to compensation for lost income, health-care bills, and noneconomic damages. However, making a successful claim is a legally complex process. Your injury lawyer will have to prove negligence, liability, and damages. This may require eyewitness and expert testimonies, doctors’ records, the police report, photos, and other evidence.
Your accident attorney may also use data from the electronic control module, or “black box,” to support your claim. This is a device that records information about the number of hours a truck spends on the road, average and high speeds, seatbelt use, and other data. It may help your personal-injury lawyer prove liability and negligence.
If you were injured by a negligent trucker, contact Antin, Ehrlich & Epstein, LLP. An accident attorney in New York City will evaluate your case, structure your claim, and help you pursue the maximum compensation for lost income, medical expenses, and noneconomic damages.

Getting a Court Order to Access Black Box Data
As the National Conference of State Legislatures Explains, black box data can only be downloaded with the permission of the vehicle owner or policyholder. However, there are certain exceptions to this rule.
In New York, black box data may be accessed in the following situations:
- If the truck owner gives permission;
- If you or your injury lawyer obtains a court order;
- When conducting vehicle safety research;
- When servicing, repairing, or diagnosing the vehicle;
- Or for the dispatch of emergency medical workers.
After a truck crash, it is critical that you contact an accident attorney as soon as possible. The truck driver, owner, or another liable party may delete the black box data before you can access it.
Are You Entitled to Compensation?
All drivers have a duty to operate their vehicles in such a manner that does not threaten the safety of other road users. If a driver breaches that duty by behaving negligently, then he or she may be liable for damages.
When truckers speed, drive under the influence of alcohol or drugs, engage in distracting behavior, and otherwise behave negligently, they are breaching their duty toward other road users. If you suffered an injury due to a truck driver’s negligence, then you may have grounds for a personal-injury claim.
