Your lawsuit, on the other hand, is a civil action. The only possible results involve the awarding of monetary damages. The expectation is that monetary awards will serve to deter people from being negligent and creating conditions that allow accidents such as yours to occur. The civil justice system has no power to punish a defendant with jail or even a fine.
