Get medical attention first, even if you feel fine. Injuries don't always show up right away. Document everything you can: photos, witness names and numbers, and a police report if one applies. How long do I have to file a personal injury lawsuit in New York?

In New York, you generally have 3 years from the date of the accident to file most personal injury lawsuits. Medical malpractice cases carry a shorter window, 2 years and 6 months. And if your claim is against the City of New York or another government entity, you must file a Notice of Claim within 90 days, well before the lawsuit itself. Don't wait for the deadline to close in. Evidence fades and witnesses get harder to find.
